Terms of Service

These terms apply to mobile hookah services provided by Heavy on the Hookah ("we", "us") in the Houston, Texas area. By booking with us, you agree to them. Nothing here replaces a written quote or booking confirmation — where the two differ, your booking confirmation governs.

1. Age restriction

Our services are strictly for adults 21 years of age or older. Every guest who uses the hookah must be 21+, and our attendant may request ID at any point. We reserve the right to refuse service to, or stop service for, any guest who cannot verify their age, and to end an event without refund if minors are given access to the hookahs.

2. Quotes and booking

Prices shown on our site are starting prices. Your final quote depends on guest count, hours, number of hookahs, location and any add-ons. A quote is not a reservation — your date is only held once the booking is confirmed and the retainer is received.

Retainer. A retainer of 50% of your total is required to reserve your date. On our standard packages that is $162.50 for Bronze, $222.50 for Silver and $362.50 for Gold; on custom bookings it is half of the quoted total. The retainer is not a deposit held on your behalf — it compensates us for holding your date and turning away other work for it, and it is non-refundable except as described in section 3. It is applied in full toward your total, so it reduces what you owe on the day.

Balance. The remaining 50% is due on the day of your event, before setup begins. We accept payment by the methods listed on your booking confirmation. Setup will not begin until the balance is paid.

3. Cancellations and rescheduling

14 or more days before your event. Your retainer is not refunded in cash, but it is credited in full toward a future booking with us. The credit is valid for 12 months from your original event date and can be used on any package, subject to availability.

Less than 14 days before your event. The retainer is forfeited. By that point we have almost certainly turned down other work for your date and can no longer rebook it. You owe nothing further — the balance is not charged.

Rescheduling. If you move your event 14 or more days out from the original date, we will transfer your retainer to the new date at no charge, subject to availability. A change requested less than 14 days before the event is treated as a cancellation under the terms above.

If we cannot perform. If we are unable to deliver due to circumstances outside our control — severe weather, road closures, venue denial, vehicle failure or similar — you may choose either a full refund of everything you have paid, including the retainer, or a transfer to another available date.

5. Service area and travel

We serve Houston and the surrounding areas, including The Woodlands, Sugar Land, Katy, Pearland and Cypress.

There is no travel fee within 30 miles of downtown Houston, which covers the large majority of the areas we serve. Beyond that, travel is billed at $2 per mile for each mile past the 30-mile mark, measured one way by driving distance. Any travel fee is calculated and stated in your written quote before you book — it is never added afterward.

6. Health, safety and assumption of risk

Hookah smoking carries health risks, including exposure to carbon monoxide, tar, nicotine and other harmful substances. It is not a safe alternative to cigarettes. Guests who choose to use the hookah do so voluntarily and at their own risk. We recommend that anyone who is pregnant, nursing, or who has a heart, lung or other medical condition does not use the hookah.

We sanitize equipment before and after every event and provide individually wrapped single-use mouthpieces. Sharing mouthpieces is not permitted.

7. Alcohol and conduct

Our attendants may decline to serve any guest who appears intoxicated or behaves unsafely toward our staff or equipment. If an event becomes unsafe, we may end service early without refund.

8. Limitation of liability

To the fullest extent permitted by Texas law, our total liability arising out of or relating to our services is limited to the amount you paid us for the event in question. We are not liable for indirect, incidental or consequential damages.

9. Photography

We may photograph our own setups for our portfolio and social media. We do not photograph guests as the subject without permission. If you would prefer we take no photos at your event, just tell us and we won't.

10. Governing law

These terms are governed by the laws of the State of Texas.
